Ogólne Warunki Sprzedaży

1. Niniejsze Ogólne Warunki Reklamacji (zwane dalej OWR) mają zastosowanie do wszystkich umów, których przedmiotem jest dostawa lub sprzedaż każdego rodzaju palet produkowanych przez C.M.C. Sp. z o.o. z siedzibą w Andrychowie, ul. Przemysłowa 54 (KRS 0000197403, NIP 9451559352), a także umów na usługi serwisowa palet, chyba że strony w umowie w sposób wyraźny wyłączyły ich obowiązywanie.

1. These General Terms and Conditions of Complaint (hereinafter referred to as "GTCC") shall apply to all contracts the subject of which is the supply or sales of each type of pallets produced by C.M.C. Sp. z o.o. based in Andrychów, ul. Przemysłowa 54 (KRS - National Court Register: 0000197403, NIP - Tax Identification Number: 9451559352), as well as contracts for pallet maintenance services, unless the parties to the contract explicitly exclude their validity.

2. Niezależnie od zastrzeżenia zawartego w pkt 1, nabywca palet lub nabycwa usług jest dodatkowo informowany o obowiązywaniu OWR poprzez zastrzeżenie zawarte w treści dokumentów potwierdzających sprzedaż/dostawę palet (np. potwierdzenie zamówienia, dokument wydania z magazynu, faktura VAT).
2. Notwithstanding the reservation set forth in Article 1, the Purchaser of pallets or the Purchaser of services is additionally informed about the validity of GTCC by means of the reservation included in the wording of documents confirming the sales/supply of the pallets (e.g. order confirmation, inventory issue document, VAT invoice).

4. Reklamacje dotyczące niezgodności ilościowej lub jakościowej sprzedanych/dostarczonych palet lub usług ich serwisowania należy składać w formie pisemnej w terminie 7 dni od dnia odbioru palet.
4. Complaints concerning a quantitative or qualitative discrepancy of the pallets sold/supplied or services of its maintenance must be lodged in writing within 7 days from the date of the pallet acceptance.

d) whether the complaint concerns all the purchased pallets/performed maintenance services or only some of them,

10. W szczególnie skomplikowanych przypadkach, a także na żądanie nabywcy, C.M.C. Sp. z o.o. może powołać biegłego celem ustalenia czy reklamowane palety lub wykonane usługi są wadliwe. W przypadku, gdy biegły ustali, że reklamowane palety lub wykonane usługi są wolne od wad, koszty biegłego pokrywa nabywca.
10. In particularly complicated cases, as well as upon the request of the Purchaser, C.M.C. Sp. z o.o. may call an expert to establish whether the claimed pallets or performed services are defective. In the case when the expert establishes that the claimed pallets or performed services are free of defects, the costs of the expert shall be covered by the Purchaser.

11. Reklamacja będzie rozpatrywana w terminie 7 dni od dnia jej otrzymania przez C.M.C. Sp. z o.o., zgodnie z postanowieniami pkt 5, chyba że zachodzi jeden z przypadków wymienionych w pkt 12.

11. The complaint shall be considered within 7 days from the date of receiving it by C.M.C. Sp. z o.o., in accordance with the provisions of Article 5, unless one of the cases mentioned in Article 12 applies.

14. W przypadku uwzględnienia reklamacji wymiana wadliwych palet na palety wolne od wad nastąpi w terminie 7 do dnia uwzględnienia reklamacji, chyba że strony uzgodnią inny termin. Wymiana palet następuje na koszt C.M.C. Sp. z o.o. W przypadku uznania reklamacji wadliwe wykonanej usługi Strony uzgodnią sposób i termin ponownego wykonania usługi na koszt C.M.C. Sp. z o.o.
14. In the case of admitting the complaint, the replacement of defective pallets to pallets free of defects shall take place within 7 from the date of admitting the complaint, unless the parties agree another date. The replacement of the pallets shall take place at the expense of C.M.C. Sp. z o.o. If a complaint is accepted for a defective maintenance service, the Parties will agree on the method and date of re-performance of the maintenance service at the expense of C.M.C. Sp. z o.o.

16. W przypadku reklamacji stosuje się OWR obowiązujące w dniu sprzedaży/dostawy reklamowanych palet lub w dniu wykonania reklamowanych usług.
16. In the case of a complaint, the GTCC valid on the date of the sales/supply of the claimed pallets or on the date of performed maintenace service shall apply.
